  • At the end of the exit, turn left and follow the signs 'Tuindorp-Oostzaan'
  • You are now driving on the Verlengde Stellingweg / S118, from here it is a 3 minute drive to Biker Outfit
  • At the 1st junction turn right at the traffic lights, on to the Molenaarsweg / S118
  • Keep straight ahead on this road S118
  • On the right side you will pass a BP gas station
  • At the roundabout (recognizable by the large NDSM sign), take the 1st exit (Hardwareweg)
  • Then take immediately the 1st left. On the corner stands a red mailbox and a sign for the Keerkringpark. You are now riding on the Netwerkweg

Coming from the Coentunnel / A10-Ring West

  • Shortly after the Coentunnel on the A10 take exit S118 direction Oostzanerwerf / Tuindorp Oostzaan

Biker Outfit is located in the upcoming North part of Amsterdam, near the NDSM Wharf. Companies such as MTV studios, Red Bull, HEMA, interesting architecture and great restaurants and shops are just around the corner. Near the NDSM ferry from Central Station and easily accessible from the A10-ring Amsterdam.

Yes, you can park for free. There is plenty of space in front of the shop!

The ferry from Central Station to the NDSM Werf is an easy and exciting connection to Amsterdam North. It is free of charge and leaves 2 times per hour - in rush hours 4 times. Ferry’s that are crossing on the IJ are departing from De Ruyterkade, the ‘back’ of Central Station. Travel time of the ferry is ± 15 minutes.

But it is still a 15-minute walk from the ferry to the Netwerkweg.

So, an alternative is to take a Connexxion bus from Central Station, which stops in front of the shop. The total travel time in this case is probably shorter than the ferry.

From Amsterdam Central 2 Connexxion buses are going on a regularly basis to the Netwerkweg. Total travel time is ± 20 minutes.
- Bus 391 (direction Zaandam - Zaanse Schans)
- Bus 394 (direction Zaandam Station)

You get off at bus stop Keerkringpark. 150 meters earlier you just passed Biker Outfit on your left hand. So after getting off, you have to cross the road and walk shortly in the opposite direction.

When your order will be shipped is stated in the order confirmation. This email has the subject Shipment date ORDxxxxxx at Biker Outfit. We ship all our orders via PostNL.

Shipping takes place on the same or next working day. So if you have ordered on a Saturday or Sunday or public holiday and the product is in stock, your order will be shipped on Monday or next working day.

Your order will be shipped at the moment that all products are in stock.

If your order includes several items and not all of them are immediately available, you can choose an option to send available items upfront and have the others being send afterwards. Please contact our customer service.

As soon as the order is shipped, we will send an email with a track & trace number, with which you can track the status of your order after 00:00 via the PostNL website.

Your order will be shipped at the moment that all products are in stock. If your order includes several items and not all of them are immediately available, you can choose an option to send available items upfront and have the others being send afterwards. Please contact our customer service.

If you are not present at the time the order arrives, the order will be delivered to the neighbors or will be offered to you again the next day.

If you are not present at the second delivery attempt, the order will be delivered to the nearest pick-up point. PostNL will only inform you digitally and therefore no longer leave a paper note if you are not at home. Consult the track & trace, so you always know where your package is.

TIP: have the order delivered to the address where you are present during the day by entering a different delivery address, for example at work.

That is possible! In the ordering process you have the option 'Ship my order to a different address'. Enter the details of the desired delivery address and you will receive the order there. When paying with Klarna (afterpay), the billing address and the shipping address must be the same.

If you wish to pick up your order at a PakjeGemak location of PostNL, you can choose this option in the shopping cart.

Once the shipment has been delivered to the pickup point, you have a period of 7 days to collect the shipment. After this period, the order will be returned to us.

After submitting your proof of identity, the pickup point will give you the shipment.

It is also possible that another person collects your shipment at the pickup point. He or she must bring his or her own proof of identity as well as that of yours (originals required).

All stated prices include VAT according to the Dutch rate (21%) or the VAT rate as applied in the country to which you have your order sent. From July 1, 2021, the way VAT is levied on online sales has changed. From this date, we will charge you the VAT rate of the EU country where you are located.

We offer the possibility to pay later with the payment provider Klarna. This is possible in the Netherlands, Belgium and Germany.

Klarna applies a maximum order amount of € 1,500 for new Klarna-customers and a limit of € 2,500 for existing Klarna-customers. You will go through their checks to estimate the maximum credit amount for you. This, therefore, differs per person.

The invoice, with payment specifications, will be sent to you by Klarna. That will be done by e-mail, a few days after we have shipped your order. This invoice must be paid to Klarna within two weeks of receipt of the order.

Note: with this payment method it is important that shipping and billing address are the same and that you enter your date of birth in the shopping cart.

We do not yet offer the possibility to pay in terms. We expect to be offering this service in 2023.

Yes, they are. In the shop all our items have a MSRP label. But when scanning and paying at the checkout, the price will be equal to the (discounted) online price if applicable.

Yes, in general you pay VAT on your purchase and the shipping costs. If you order from a NON-EU country or as a company in an EU country, the VAT will be automatically deducted when you order in our webshop.

All prices are including VAT according to the Dutch rate (21%) or the VAT rate as applied in the country where you ship your order to. Because from 1 July 2021, the way VAT is calculated on online sales has changed. From this date we will charge you the VAT rate of the EU country where you are located.

In the shop the VAT always has to be paid. It is possible to get a refund form, with which you can reclaim partially the VAT paid by you in the shop. In the shop we do not need any information from you, so you do not have to bring a passport or something else.

The way VAT is levied on online sales is calculated according to the EU country where you are based.

The Dutch VAT rate is 21%. If you place an order and have it shipped to one of the countries below, the VAT rate and thus the final price will be changed in the check out. If your country uses a lower VAT rate, your final price will be lower, if it is higher, the final amount will be higher.

Unfortunately this is not possible. We can only deduct the full VAT if we ship items to a country outside the EU or to a company in an EU country.

Yes, we cooperate with Global Blue.

When you are buying articles in our shop in Amsterdam (with a minimum of € 60) and you will return to your country outside the EU within 3 months, you can have a tax refund at a Global Blue office. The are located on almost every airport around Europe, so in case you are traveling through, you still can have your tax refunded at the airport where you are leaving Europe.

In the shop, VAT always has to be paid completely. It is possible to get a refund form from Global Blue, with which you can reclaim partially your paid VAT. In the shop we do not need any details from you, so you do not have to bring a passport or anything else.

The bigger the amount you spent in the shop, the higher the percentage of the refund. On average, this TAX refund is about 11% of the amount spent.

ORDERING & STOCK

You can change (such as ordered items or delivery address) or cancel an order as long as your order has not yet been shipped. The fastest way to change or cancel is to call our customer service. They know the status of your order.

Did you forget to order something? And the purchase amount of this item is not above the minimum order amount of free shipping? Then you can add an item to a current order as long as your order has not yet been shipped.

To be sure, please contact our customer service in advance to request the status of your order and whether it is therefore still possible to add an item.

If it is possible to add an item to your current order, you can do this as follows.
- Go to our website and order the item
- When checking out, choose 'Pick up at our shop in Amsterdam'
- Write in the comments: 'Please add to ORDxxxxx'. And ORDxxxxx is the order number of your previous order

This way you do not have to pay shipping costs again and we add the item to the order with ORDxxxxx. If it doesn't work, you can always call or email our customer service.

Placing an order is simple:

- have been a showmodel for photography, fairs, representatives etc.

Samples are indistinguishable from the regular collection. Most samples come in sizes large for men and medium for women. Is your size not listed? Unfortunately we can't order it for you.

REV'IT samples are delivered irregularly, stock updates can be found on our website.

To date, manufacturers have not yet indicated whether a product is vegan. In addition, producers are never complete in the information about the use of materials. So unfortunately we can never say with certainty that no animal products have been used in a certain article.

If this changes in the future, we will communicate this on the website by creating a filter or category.

Adding an item to your shopping cart does not imply a reservation. To ensure that you receive the item, you must order an item. It is therefore not possible to reserve items on our website. Even if you have ordered an item for which the payment has not been successful, it will not be reserved.

GIFT CARD & DISCOUNT CODE

Yes, we do!

The gift card is available in multiples of € 25, € 50, € 75 or € 100, but you can also enter any other desired amount. The gift card can be redeemed in the shop and online. So whether the gift card has been purchased in the shop or in the webshop, it does not matter for the redemption.

When purchasing the gift card in the shop you will receive a physical gift voucher in a nice gift box. If you buy a gift card in our webshop, you will only receive a digital code by email.

ORDER A GIFT CARD

A gift card is valid indefinitely, we do not use an end date for a gift card.

Yes, it does not matter whether a gift card was purchased in the shop or webshop. Both can be redeemed in the webshop as well as in the shop.

In the shop you show us the gift card in print or on your mobile. In the webshop you can enter the full code during check out in the box 'Gift card code' and click on 'Apply'. The balance on the gift card will automatically be deducted from your purchase.

Multiple gift cards?
No problem! You can simply redeem multiple gift cards per purchase.

Purchase amount lower than the balance on your gift card?
Then only the amount of your online order will be debited from the gift card. The next time you can simply use the remainder of the gift card in the shop or online webshop.

Purchase amount higher than the balance on your gift card?
If the order amount is higher than the value of the gift card, you will automatically be asked to select a payment method to pay for the rest of your order.

Unfortunately it is not possible to pay with a VVV voucher or other gift cards (such as Fashioncheque, Fashiongiftcard, Webshop Giftcard). We only accept our own Biker Outfit gift card.

There are 2 types of discount codes in our webshop.

General discount codes
These are the discount codes that we communicate with the articles in our webshop. When you enter this, the amount of your order will immediately be reduced by the value of your discount code.

Personal discount codes
These are discount codes that you receive when you sign up for our newsletter, for example.

Please note that the discount code is not applicable to shipping costs, gift cards and cannot be used in combination with any other discount code.

You can enter your discount code during the last step of your order in the field 'Discount code' and click on 'Apply'. The invoice amount of your order is then immediately reduced by the value of your discount code.

General discount codes : automatically
These are the discount codes that we communicate with the articles in our webshop. The price with the online discount code will be automatically calculated in our shop, you don't have to do anything for this. When scanning and paying at the checkout, the price will therefore be equal to the price in the webshop with discount code.

Personal discount codes : not possible
It is also possible that you have received a unique, personal discount code when you register for our newsletter, for example. This discount code can only be used online and cannot be redeemed with a purchase in our shop.

Gift card
Did you place an order and forgot to enter the gift card code? Unfortunately, this cannot be settled afterwards with an order. Of course you can use your gift card for a next order.

General discount code
These are the discount codes that we communicate with the articles in our webshop. Did you forget to fill this in during checkout? Then please contact our customer service. They can refund the amount that you would have had as discount with the use of the discount code.

Personal discount code
These are discount codes that you receive when you sign up for our newsletter, for example. With this discount code it is unfortunately not possible to settle it after payment. If you have forgotten to redeem a discount code, you can always use it for a subsequent order.

Unfortunately, discount codes or gift card cannot be paid out in cash. Of course you can simply use the remaining amount of your gift card or your discount code when placing a new order.

RETURNS, EXCHANGE & REFUND

The easiest and fastest way to do so is by using our returns form. You will find the return form with your order (in the box or otherwise) and it contains all the information to return your order to us.

If you no longer have this, you can download this return form and all information here.

We expect the returned product:
- to be in it's original (new) condition;
- to not have been worn or used (outdoors) in any other way;
- to be provided with all original labels and/or packaging.

So, not happy with your purchase? Then return your product and preferably in the packaging with which you received your order from us. If a product is damaged or not in it's original condition we will examine the item and determine the devaluation.

Returned items are your responsibility until they reach us, so make sure they are properly packed and cannot be damaged in transit. Also always ask for proof of your return, in case you need to contact us about this or in case something goes wrong en route.

No, unfortunately we do not have freepost to return your order to us. We also do not provide a (free) return shipping label. The costs for returning your order are for your own account.*

* Of course, in case of incorrect delivery by Biker Outfit, clients will be reimbursed for the costs of return shipments

Online exchange for another item is unfortunately not possible for webshop orders. All returned items will be processed for a refund once they have been received by our warehouse.

Would you like to receive another item?
- Then we advise you to order it in our webshop.
- As soon as we have received your original order back, we will make the refund.

Items purchased in the webshop can also be returned in the shop in Amsterdam. The refund of the purchase amount will be made via the webshop, the same way in which the original transaction was made.

Do you want to exchange your webshop order in the shop in Amsterdam? That is possible in many cases, not always.

The purchase amount is equal to or higher than the purchase amount of your webshop order
Then we will exchange the item or the purchase amount of your returned webshop order will be deducted from what you want to take from the shop. In the latter case, you pay the difference at the checkout in the store.

The purchase amount is lower than the purchase amount of your webshop order
We cannot return money for webshop orders instore, not even partially. Therefore, the complete purchase amount of your returned webshop order will be refunded via the webshop. The items you want to take from the shop will have to be paid in full at the checkout.

Online orders paid through Klarna
If you have placed an online order via Klarna (pay later), the purchase amount of your returned webshop order will be deducted from Klarna. The items you want to take from the shop will have to be paid in full at the checkout.

Items purchased in the shop can also be returned to us by post. As soon as we have received your item(s) back, we will make a refund by bank transfer. We aim to do so within 3 to 5 working days after receipt of the return. For a smooth handling, we ask you to use the enclosed return form.

Do not forget to enclose (a copy of) the purchase receipt.

RETURN SHIPMENT
The shipment costs for returning your order are for your own account.*

* Of course, in case of incorrect delivery by Biker Outfit, clients will be reimbursed for the costs of return shipments

REFUND MONEY
After we have received your return, we will refund the amount as soon as possible in the same way the original transaction was made. There will be no additional costs for you to receive your original purchase amount back.

You can exchange or return your order within 30 days of receipt. The 30-day reflection period starts after the item(s) have been purchased in the shop or have been physically handed over by the carrier to the person who placed the order or a third party who has signed for receipt.

No problem! You can download the return form here.

Yes, that's possible! Make sure that you put a separate return form in the package for each order. Fill in all the details, such as your order number and which items you are returning to us so that we can handle this for you as quickly as possible.

Of course you can return items you don't want to keep. If you have paid for your order in full with a gift card, the relevant amount will be credited back to the gift card once the return has been processed.

If the order amount is higher than the value of the gift card and you paid the rest with another payment method, the amount you paid with this other method will be refunded via this payment method. The remaining amount will be credited to your gift card.

After we have received your return (in the shop in Amsterdam or by post), we will refund the amount as soon as possible in the same way that the original transaction was made.

WEBSHOP ORDERS
For webshop orders, the refund will be made with the same payment method with which your original purchase was made. If you have chosen Klarna - pay afterwards with your order, this will be deducted from your Klarna account.

SHOP PURCHASES
For shop purchases, this is by debit card or cash. Credit card payments in the shop can only be refunded in cash.

WEBSHOP ORDERS
For webshop orders, processing takes place within 5 working days after we have received your return (in the shop in Amsterdam or by post).
- Klarna: immediately adjusted after processing.
- iDEAL or PayPal: in general, after processing, you will receive your purchase amount back the next working day.
- Credit card: it may take longer after processing before the money is back in your account. This depends on the credit card company and your bank. It can sometimes take 1 week or more for the refund to be processed. Unfortunately we have no influence on this.

SHOP PURCHASES
Returns of shop purchases will be processed immediately when you hand them over at the checkout.
- Cash: immediately.
- Pin refund: in general, you will have the purchase amount back in your bank account the next working day.

You can only return an item that has been used, tried on or worn if that use, fitting or wearing is the same as you would be allowed to do before the purchase in our shop in Amsterdam. This means that items to be returned may only be used, tried on or worn to examine whether you wish to keep the item. We expect the returned item:
- to be in it's original (new) condition;
- to not have been worn or used (outdoors) in any other way;
- to be provided with all original labels and/or packaging.

If a product is not in it's original condition, has been returned damaged or is incomplete, we will examine the condition of the product and determine the devaluation.

A few products are excluded when it comes to returning or exchange.

Hearing protection can not be returned by reasons of hygiene. The same applies to pinlock lenses, communication systems and navigation systems. Unfortunately, we can not take them back when the seal is broken.

WARRANTY & SERVICE

If you have placed the order with an account
Check if there was no error in your email address when logging into your account. If so, please correct it. Also check in your mailbox whether the e-mail confirming your order was not considered spam and placed in your 'unwanted e-mails'.

Was the email address you entered with your order incorrect? Then you can only change it to an email address that does not yet have an account in our webshop. If the e-mail address is already in use with another account, you must enter another valid e-mail address.

If you placed the order as a guest
Check in your mailbox whether the email confirming your order was not considered spam and placed in your 'junk mail'.

In case of doubt, don't hesitate to contact our customer service. Give us a call or send us an email. We can investigate what went wrong. We may email you a reset link with which you can create a (new) password and then log in to your account in our webshop.

Have you received a damaged item or the wrong item? Is an item missing from your order? We apologize for this.

If you have received a damaged or incorrect item, please contact our customer service before returning the items. We will contact you and offer the fastest and most pleasant solution to solve this matter.

Shipping costs are always reimbursed by Biker Outfit in case of incorrect delivery.

If an order from Biker Outfit cannot be found or cannot be traced, please contact our customer service. They will find out for you where your package is currently located and otherwise look for a solution.

It is possible that your order is not accepted by Klarna. Unfortunately, we cannot state the reason for this. The best is to contact Klarna.

If your discount code doesn't work, it could be due to several reasons:
- You have already used your discount code;
- The period of validity of your discount code has expired;
- The items in your shopping cart are not eligible for the offer linked to the discount code;

The legal guarantee applies to every product, which means that a product must do or be what you can reasonably expect from it.

In addition to the legal warranty, the manufacturer's warranty also applies. If there is a manufacturer's warranty, you can find this on the official website of the manufacturer. The manufacturer's warranty does not affect the legal warranty.

You only have a warranty with a well-founded complaint. The complaint is valid if it is not caused by:
- damage due to intent or negligence (for example, washing, fall and/or impact damage)
- improper use or negligent maintenance
- normal wear and tear and/or damage due to non-compliance or incorrect observance of the instructions for use

ARTICLE 1. | DEFINITIONS

In these general terms and conditions, the following terms, always capitalized, are used with the following meaning.

  1. Biker Outfit: Biker Outfit Webshop B.V., the user of these general terms and conditions, located at Annaloogstraat 27, 1033 MR in Amsterdam.
  2. Customer: any natural or legal person with whom Biker Outfit has concluded or intends to conclude an Agreement.
  3. Consumer: a Customer, natural person, not acting in the exercise of a profession or business.
  4. Parties: Biker Outfit and the Customer jointly.
  5. Agreement: any agreement between the Parties in the context of which Biker Outfit commits itself to the Customer for the sale and delivery of Products and/or a Gift Card.
  6. Distance Agreement: an Agreement concluded between Biker Outfit and a Consumer within the framework of an organized system for the conclusion of a distance contract without the simultaneous personal presence of Biker Outfit and the Consumer and whereby, up to and including the moment of the conclusion of the the Agreement, exclusive use is made of one or more means of distance communication, such as in the case of an Agreement concluded by a Consumer through the Webshop. An Agreement is therefore not a Distance Agreement if Biker Outfit does not use an organized system for the conclusion of a distance contract, for example if the Consumer looks up Biker Outfit's contact details on the internet or in a telephone book and concludes an Agreement by telephone.
  7. Webshop: www.bikeroutfit.nl.
  8. Products: the goods to be sold and delivered by Biker Outfit to the Customer in the context of an Agreement, which may include motorcycle clothing, helmets, gloves, boots and shoes, luggage bags and accessories, protection equipment , rainwear etc.
  9. Gift Card: a physical or digital gift card ordered through the Webshop and to be delivered by Biker Outfit to the Customer that can be redeemed at Biker Outfit when purchasing and delivering Products.
  10. Written: communication in writing, communication by e-mail or any other form of communication that can be equated with this in view of the state of the art and prevailing views in society.

ARTICLE 2. | GENERAL PROVISIONS

  1. These general terms and conditions apply to every offer from Biker Outfit, every Agreement and all legal relationships arising therefrom between the Parties.
  2. The applicability of any general terms and conditions of the Customer is expressly rejected.
  3. The provisions of these general terms and conditions can only be deviated from expressly and in writing. If and insofar as what the Parties have expressly agreed in Writing deviates from the provisions of these general terms and conditions, what the Parties have agreed explicitly and In Writing will apply.
  4. The nullity or nullity of one or more of the provisions of these general terms and conditions or the Agreement as such does not affect the validity of the other provisions. In such a case, the Parties are obliged to enter into mutual consultation in order to make an alternative arrangement with regard to the affected clause. In doing so, the purpose and purport of the original provision will be taken into account as much as possible.

ARTICLE 3. | OFFER AND CONCLUSION OF THE AGREEMENT

  1. Every offer from Biker Outfit is without obligation and subject to sufficient availability of the Products offered. Biker Outfit can revoke its offer until immediately, or at least as soon as possible after its acceptance by the Customer. ARTICLE 4. | RIGHT OF WITHDRAWAL FOR DISTANCE AGREEMENTS

  1. Subject to the provisions of the rest of this article, the Consumer can revoke the Distance Agreement up to 30 days after receipt of the Products, without giving reasons. If the Distance Agreement provides for the delivery of a Gift Card, the Consumer can, subject to the provisions of paragraph 3, revoke the Distance Agreement up to 30 days after its conclusion, without giving reasons.

In the case of delivered Products that may be returned under the right of withdrawal, the Consumer must handle the relevant Products and their packaging with care during the period referred to in paragraph 1. The Consumer may only handle and inspect the Products to be returned to the extent necessary to assess the nature and characteristics of the Products.   9. If the Consumer makes use of the right of withdrawal, the costs of returning the Products will be borne by the Consumer.

Biker Outfit will refund to the Consumer any payment already received from the Consumer, minus any reduction in value, as soon as possible, but no later than 14 days after revocation of the Distance Agreement, provided that the Products have been received back by Biker Outfit, then it has been demonstrated by the Consumer that the Products have actually been returned.   4. Damage caused as a result of force majeure will never be eligible for compensation, without prejudice to the provisions of the previous paragraph.

ARTICLE 10. | SUSPENSION AND DISSOLUTION

  1. Biker Outfit is, if the circumstances of the case reasonably justify it, authorized to suspend the performance of the Agreement or to dissolve the Agreement in whole or in part with immediate effect, if and insofar as the Customer does not fulfill its obligations under the Agreement, fails to fulfill its obligations on time or in full, or circumstances that have become known to Biker Outfit after the Agreement has been concluded give good grounds to fear that the Customer will not fulfill its obligations.   5. If Biker Outfit dissolves the Agreement on the basis of this article, all claims against the Customer are immediately due and payable.

ARTICLE 11. | PRICES, SHIPPING & PAYMENTS

  1. Whether, in the case of delivery, shipping costs will be borne by the Customer and what the amount thereof will depend on the country of delivery and the order amount.   4. Gift cards cannot be exchanged for money.

ARTICLE 13. | GENERAL COMPLAINT POLICY

  2. If the complaint cannot be resolved in mutual consultation in the context of a Distance Agreement, the Consumer can submit the dispute to the disputes committee via the ODR platform (ec.europa.eu/consumers/odr/).

ARTICLE 14. | RETENTION OF TITLE

  1. All Products delivered by Biker Outfit to the Customer remain its property until the Customer has properly fulfilled all its payment obligations under the relevant Agreement.
  2. The Customer is prohibited from selling, pledging or encumbering in any other way the Products subject to retention of title.
  3. The Customer is obliged to keep the Products delivered under retention of title with due care and as recognizable property of Biker Outfit.
  4. If third parties seize the Products subject to Biker Outfit's retention of title, or wish to establish or enforce rights thereon, the Customer is obliged to inform Biker Outfit of this as soon as possible.
  5. In the event of violation of the provisions of this article, the amount owed by the Customer to Biker Outfit will become immediately due and payable in full.
  6. The Customer gives unconditional permission to Biker Outfit or third parties designated by Biker Outfit to enter all those places where the Products subject to retention of title are located. ARTICLE 15. | FINAL PROVISIONS

  1. Biker Outfit is entitled to change these general terms and conditions. In such a case, the Customer will be notified of this, whereby the amended general terms and conditions will be provided to him and after which they will apply. In the case of a Consumer, amended general terms and conditions do not apply to an Agreement that has already been concluded if and insofar as the amendments are to his detriment.
  2. Dutch law applies exclusively to each Agreement and all legal relationships arising therefrom between the Parties.
  3. The parties will not appeal to the courts until they have made every effort to settle the dispute in mutual consultation.

Only the competent court within the district of the District Court of Amsterdam will be appointed in the first instance to take cognizance of any legal disputes between the Parties, without prejudice to the right of Biker Outfit to designate another competent court according to the law.   2. Obvious errors, mistakes and clerical errors in an offer from Biker Outfit do not bind Biker Outfit.

  4. Without prejudice to the provisions of paragraphs 1 and 5, each Agreement is concluded at the moment that the offer of one Party has been accepted by the other Party. An oral offer must be accepted immediately, failing which the offer will lapse.

ARTICLE 4. | EXCHANGE AND RETURN OF PRODUCTS

ARTICLE 6. | GIFT CARDS

  1. A Gift Card can be used to order Products. The Gift Card can be used to pay the full amount of an order or part thereof. If the total amount of the order exceeds the value of the Gift Card, the Customer can use an additional payment method to complete the purchase.
  2. The purchase of a Gift Card cannot be canceled and Gift Card cannot be returned.
  3. A Gift Card is valid for 24 months after the date of purchase. If this period of validity has expired, the Gift Card can no longer be used for a purchase, cannot be reactivated and the (residual) value of the Gift Card will lapse.
  4. When purchasing a Gift Card, the Customer determines the value of the Gift Card. This value is a maximum of € 500 and a minimum of € 10. The balance of a Gift Card cannot be increased or decreased, other than a decrease as a result of the purchase of Products. A Gift Card can be used until its value has been used up in full.
  5. The invoice of the order for which payment was made with the Gift Card always shows the balance of the Gift Card. In addition, the current balance can be checked at www.bikeroutfit.nl/nl/giftcard, in the Biker Outfit store or by contacting Biker Outfit customer service.
  6. Biker Outfit is never liable for damage as a result of theft, loss or damage to the Gift Card.

ARTICLE 7. | GENERAL CUSTOMER OBLIGATIONS

The Customer guarantees that it will provide Biker Outfit with all information that is reasonably relevant to the set-up and implementation of the Agreement, in a timely manner, completely and in any manner prescribed by Biker Outfit. The Customer guarantees the correctness of this information. Furthermore, the Customer must always provide Biker Outfit with all cooperation required for the implementation of the Agreement. The Customer takes all reasonable measures to optimize the performance of the Agreement.

ARTICLE 8. | SPECIAL PROVISIONS FOR WORK

  1. Work will be performed at Biker Outfit's location, unless expressly agreed otherwise in Writing. The Customer guarantees that the item on which the Work is performed will be made available to Biker Outfit in a timely manner. In the event that the Parties have agreed that this item will be sent, the item will be delivered to Biker Outfit at the expense and risk of the Customer.
  2. The Customer's item must be received by the Customer after completion of the Work. In the event that the item is returned to the Customer, the Customer guarantees that the item will be received by or on behalf of the Customer at the time the item is presented by the delivery person. Any costs of returning the case to Biker Outfit because the case has not been received by or on behalf of the Client as a result of a circumstance attributable to the Client, will be borne by the Client.
  3. If the item is collected from Biker Outfit after completion of the Work, this must be done within a reasonable period of time.
  4. Biker Outfit has a right of retention with regard to anyone who demands delivery of the goods of the Customer that Biker Outfit has in its possession in connection with the implementation of the Agreement. Biker Outfit can also exercise the right of retention vis-à-vis the Customer for what is still owed to it in connection with any previous Agreements.
  5. The case of the Customer that Biker Outfit has in its possession in connection with the implementation of the Agreement also serves as a pledge for all claims it has against the Customer.
  6. Any parts of the item removed in connection with the Work will become the property of Biker Outfit without the Customer being able to claim any compensation in this respect.

ARTICLE 9. | TERMS

  1. Biker Outfit makes every effort to comply with any implementation and/or delivery terms to which Biker Outfit has committed itself towards the Customer, but these terms are only indicative, non-fatal terms. Biker Outfit's default does not take effect until after the Customer has given Biker Outfit written notice of default, in which notice of default a reasonable term for compliance has been stated, and Biker Outfit is still in default after the expiry of the latter term. is.
  2. Default on the part of Biker Outfit entitles the Customer to dissolve that part of the Agreement to which the default relates, but never the right to additional compensation.

ARTICLE 10. | INVESTIGATION, COMPLAINTS AND WORK WARRANTY

  1. Upon return of the item to him, the Customer must immediately investigate whether the Work has been performed properly. If, in the opinion of the Customer, this is not the case, the Customer must immediately notify Biker Outfit of this.
  2. A guarantee on the Work performed only applies if and insofar as this has been expressly agreed in Writing.
  3. If, within any expressly agreed warranty period, there appears to be a shortcoming attributable to Biker Outfit with regard to the Work performed, Biker Outfit will perform the Work again free of charge. The Customer can invoke this if the Customer has complained to Biker Outfit within the applicable warranty period.
  4. Even if the Customer complains in time, his obligation to timely payment to Biker Outfit will continue to exist, except insofar as the law for the benefit of the Consumer precludes this.

ARTICLE 11. | INVESTIGATION, COMPLAINTS, WARRANTY AND CONFORMITY OF PRODUCT SALE

  1. At the time of delivery of Products, or at least immediately afterwards, the Customer must investigate whether the nature and quantity of the Products comply with the Agreement. If, in the opinion of the Customer, the nature and/or quantity of the Products do not comply with the Agreement, he must immediately notify Biker Outfit of this. In the event that the Products are delivered at Biker Outfit's location, the nature and quantity of the Products will be deemed to comply with the Agreement if the Products have been taken along by the Customer.
  2. Complaints relating to defects that were reasonably invisible or otherwise unknown at the time of delivery must be made in writing within five days after the Customer became aware of the existence of the defect, or at least should have become aware of it in writing. submitted to Biker Outfit.
  3. Contrary to the provisions of the previous paragraphs of this article, a Consumer can no longer rely on the fact that what has been delivered in the context of a consumer purchase does not comply with the Agreement, if not within two months after discovery of the defect. the Consumer has complained to Biker Outfit in this regard.
  4. If the Customer does not complain in time and in accordance with the provisions of the previous paragraphs, Biker Outfit will not be under any obligation whatsoever from such a complaint from the Customer.
  5. Even if the Customer complains in time, his obligation to pay Biker Outfit on time will continue to exist, except insofar as the law for the benefit of the Consumer precludes this.
  6. With regard to Products, the warranty is limited to any manufacturer's warranty that the supplier of Biker Outfit supplies with the Products, on the understanding that a warranty provided by Biker Outfit, manufacturer or importer does not affect the mandatory legal rights and claims. which Consumers can enforce against Biker Outfit in the context of a consumer purchase (conformity).
  7. In the event of an appeal to any manufacturer's warranty, this will be settled in accordance with the applicable manufacturer's warranty conditions of the manufacturer or supplier of Biker Outfit. Any costs passed on by the manufacturer or supplier of Biker Outfit in connection with an appeal to the factory warranty, as well as any costs incurred by Biker Outfit in connection with the mediation in an appeal to the factory warranty, will be borne by the Customer. The warranty period does not start again due to repair or replacement under the manufacturer's warranty.
  8. A claim based on non-conformity lapses in any case if a defect in the delivered Product is the result of an external cause after delivery or another circumstance not attributable to Biker Outfit or its supplier. This includes, without limitation, defects as a result of damage from the outside, natural wear and tear, incorrect or improper treatment, incorrect or improper use and making changes to the Products, including repairs that have not been carried out with the prior Written consent of Biker Outfit. executed.
  9. If the Customer returns Products under this clause, the Customer must return the Products to the store or return them by parcel post. Delivery to Biker Outfit takes place, without prejudice to the provisions of the next paragraph, at the expense and risk of the Customer; Biker Outfit is not responsible and liable for damage or loss during transport.
  10. In the event that the Consumer makes a valid appeal to non-conformity, the Consumer is entitled to repair or replacement or addition of the missing. No costs can be charged to the Consumer for the exercise of these rights. Biker Outfit will cooperate within a reasonable time in the repair, replacement or addition of the missing. If repair, replacement or supplementation of what is missing is not possible, the Consumer is entitled to a financial compensation to be determined reasonably, which, however, never exceeds the price that the Consumer has paid to Biker Outfit for the relevant Product. The amount of the financial compensation depends, among other things, on the period in which the Consumer was able to use the Product without defect.
  11. No grounds for complaints and not regarded as defects of Products, dissatisfaction of the Customer with a Product, while the Product does comply with the Agreement (has the properties that the Customer may reasonably expect or that are explicitly stated by the manufacturer or Biker Outfit). are committed). Furthermore, no grounds for complaints are properties of a Product that have been explicitly indicated by the manufacturer or Biker Outfit, but of which the Customer cannot reasonably expect these properties to be present under all circumstances or without limitation, such as with regard to the waterproofness of raincoats.
  12. If the Customer is entitled to repair of a Product under this article, he is not entitled to replacement of the Product instead if the defect is too minor to justify replacement or replacement cannot reasonably be done by Biker Outfit for other reasons. can be required. A single defect of a Product is generally no reason to designate the Product as defective in its entirety.
  13. Unless there is financial compensation due to a Consumer on account of non-conformity as referred to in the previous paragraph, and the Customer is entitled to a refund under the manufacturer's warranty, the Customer will receive this refund in the form of a credit which he can spend indefinitely at Biker Outfit.

ARTICLE 12. | FORCE MAJEUR

  1. Biker Outfit is not obliged to fulfill any obligation under the Agreement if and for as long as it is prevented from doing so by a circumstance that cannot be attributed to it under the law, a legal act or generally accepted views (force majeure). Force majeure, in addition to what is understood in this respect in legislation and jurisprudence, is understood to mean all external causes over which Biker Outfit has no influence and which make the (further) execution of the Agreement impossible or seriously impede, including staff shortages, epidemics. , pandemics, fire, measures taken by any government, transport restrictions, war or threat of war, violent or armed actions, failures in communication links or in equipment or software of Biker Outfit or third parties.
  2. If and insofar as the force majeure situation makes compliance with the Agreement permanently impossible or continues or will continue for more than three months, the Parties are entitled to terminate the Agreement with immediate effect.
  3. If Biker Outfit has already partially fulfilled its obligations upon the occurrence of the force majeure situation, or can only partially fulfill its obligations, Biker Outfit is entitled to separately invoice the part of the Agreement that has already been performed, or the part that can still be performed, respectively. if there was an independent Agreement.
  4. Damage caused as a result of force majeure will never be eligible for compensation, without prejudice to the provisions of the previous paragraph.

ARTICLE 13. | SUSPENSION AND DISSOLUTION

  1. Biker Outfit is, if the circumstances of the case reasonably justify it, authorized to suspend the performance of the Agreement or to dissolve the Agreement in whole or in part with immediate effect, if and insofar as the Customer does not fulfill its obligations under the Agreement, fails to fulfill its obligations on time or in full, or circumstances that have become known to Biker Outfit after the Agreement has been concluded give good grounds to fear that the Customer will not fulfill its obligations. If the fulfillment of the obligations of the Customer in respect of which he falls short or threatens to fall short, is not permanently impossible, the right to dissolve only arises after the Customer has been given written notice of default by Biker Outfit, in which notice of default a reasonable term is stated within which the Customer can (still) fulfill its obligations and the fulfillment has still not been forthcoming after the expiry of the latter term.
  2. If the Customer is in a state of bankruptcy, has applied for (provisional) suspension of payment, any attachment has been levied on its goods or in cases where the Customer cannot freely dispose of its assets in any other way, Biker Outfit is entitled to terminate the Agreement with terminate with immediate effect.
  3. The Customer is never entitled to any form of compensation in connection with the suspension or dissolution right exercised by Biker Outfit on the basis of this article.
  4. The Customer is obliged to compensate the damage that Biker Outfit suffers as a result of the suspension or dissolution of the Agreement.
  5. If Biker Outfit dissolves the Agreement on the basis of this article, all claims against the Customer are immediately due and payable.

ARTICLE 14. | PRICES, SHIPPING & PAYMENTS

  1. Products are collected by or on behalf of the Customer at the location of Biker Outfit, unless it has been expressly agreed that the Products will be shipped. In the event of shipment, any shipping costs will be borne by the Customer in accordance with the usual shipping costs used by Biker Outfit. In the case of a Consumer, any shipping costs will be expressly communicated to the Customer before it is agreed that the Products will be shipped.
  2. In the event that Products or an item of the Customer on which Work has been performed is collected or taken by or on behalf of the Customer at the location of Biker Outfit, payment must be made upon (return) delivery, unless expressly agreed otherwise.
  3. Biker Outfit is not obliged to (further) implement the Agreement until after the Customer has fulfilled all of its payment obligations towards Biker Outfit that are already due and payable.
  4. Payment must be made in one of the ways specified by Biker Outfit and at the time specified by it or within the term specified by it. In the event of a transfer, Biker Outfit applies a standard payment term of 14 days after the invoice date, but may deviate from this in individual cases, such as in the case of an advance payment.
  5. Gift cards cannot be exchanged for money.
  6. Payment must be made without any appeal to suspension or set-off, all this insofar as the law does not preclude this for the benefit of the Consumer.
  7. If the Agreement has been concluded electronically, Biker Outfit is entitled to make the invoice due to the Customer available to him exclusively by e-mail.
  8. If the Customer liquidates or transfers his company to a third party, is in a state of bankruptcy, has applied for a (provisional) suspension of payments, any attachment has been levied on his goods, as well as in the event that the Customer is otherwise unable to freely dispose of his assets. available, the claims against the Customer are immediately due and payable.
  9. If payment is not made on time, the Client's default will take effect by operation of law. From the day on which the Client is in default, the Client owes interest of 2% per month on the outstanding amount, whereby part of a month is regarded as a full month. Contrary to the previous sentence, instead of the contractual interest referred to there, the statutory interest applicable at the time of the payment default applies if the Customer is a Consumer.
  10. All reasonable costs, such as judicial, extrajudicial and execution costs, incurred to obtain the amounts owed by the Client, will be borne by the Client.

ARTICLE 15. | LIABILITY

  1. The Customer bears the damage caused by inaccuracies or incompleteness in the information provided by him, defects in items that he has made available to Biker Outfit in the context of the performance of Work, any other shortcoming in the fulfillment of the obligations of the Customer arising from the law or the Agreement, as well as any other circumstance that cannot be attributed to Biker Outfit. Damage resulting from a circumstance as referred to above does not offer the Customer any claim to compensation or any other compensation towards Biker Outfit.
  2. Biker Outfit is never liable for damage caused as a result of incorrect use of the Products or as a result of another cause as referred to in Article 11.8
  3. Biker Outfit is never liable for indirect damage, including loss suffered, lost profit and damage as a result of business interruption.
  4. Should Biker Outfit be liable for any damage, Biker Outfit has the right to repair this damage at all times. The Customer must give Biker Outfit the opportunity to do so, failing which any liability of Biker Outfit in this respect will lapse.
  5. Without prejudice to the provisions of the following paragraph, Biker Outfit's liability is limited to a maximum of the proper performance of the Work, or repair or replacement of the Products to which Biker Outfit's liability relates, all this only if and insofar as Biker Outfit is obliged to do so under a guarantee or a claim based on non-conformity as referred to in Article 10 or 11. If it is still not possible to carry out the Work properly or repair or replace the Products, the liability of Biker Outfit limits to a maximum of the invoice value of the Agreement, or at least that part of the Agreement to which Biker Outfit's liability relates.
  6. If an item of the Customer that Biker Outfit has in its possession in the context of Work is damaged as a result of a circumstance attributable to Biker Outfit, Biker Outfit is entitled to repair this damage (or have it repaired) at its own expense. The provisions of paragraph 4 apply mutatis mutandis. If the item is irreparably damaged or lost as a result of a circumstance attributable to Biker Outfit, Biker Outfit's liability is limited to compensation of the replacement value of the item in question. This replacement value is determined on the basis of all circumstances of the case, including in particular the state in which the item was when it was delivered to Biker Outfit and the age of the item.
  7. Without prejudice to the expiry periods as referred to in Articles 10 and 11, the limitation period for all legal claims against Biker Outfit is one year. Contrary to the previous sentence, legal claims accruing to Consumers that are based on facts that would justify the statement that a consumer purchase does not comply with the Agreement, expire after two years.
  8. In the case of a consumer purchase, the restrictions of this article do not extend beyond what is permitted under article 7:24 paragraph 2 of the Dutch Civil Code.
  9. The liability limitations from these general terms and conditions do not apply if the damage is caused by intent or deliberate recklessness on the part of Biker Outfit or its management staff.

ARTICLE 16. | RETENTION OF TITLE

  1. All Products delivered by Biker Outfit to the Customer remain its property until the Customer has properly fulfilled all its payment obligations under the relevant Agreement.
  2. The Customer is prohibited from selling, pledging or encumbering in any other way the Products subject to retention of title.
  3. The Customer is obliged to keep the Products delivered under retention of title with due care and as recognizable property of Biker Outfit.
  4. If third parties seize the Products subject to Biker Outfit's retention of title, or wish to establish or enforce rights thereon, the Customer is obliged to inform Biker Outfit of this as soon as possible.
  5. In the event of violation of the provisions of this article, the amount owed by the Customer to Biker Outfit will become immediately due and payable in full.
  6. The Customer gives unconditional permission to Biker Outfit or third parties designated by Biker Outfit to enter all those places where the Products subject to retention of title are located. The Customer must provide Biker Outfit with all information on first request in order to be able to exercise its property rights. All reasonable costs associated with the exercise of the ownership rights of Biker Outfit are for the account of the Customer.
  7. If the Customer has fulfilled its obligations after the Products have been delivered to it by Biker Outfit, the retention of title with regard to these Products will revive if the Customer fails to fulfill its obligations under an Agreement concluded later.

ARTICLE 17. | FINAL PROVISIONS

  1. Biker Outfit is entitled to change these general terms and conditions. In such a case, the Customer will be notified of this, whereby the amended general terms and conditions will be provided to him and after which they will apply. In the case of a Consumer, amended general terms and conditions do not apply to an Agreement that has already been concluded if and insofar as the amendments are to his detriment.
  2. Dutch law applies exclusively to each Agreement and all legal relationships arising therefrom between the Parties.
  3. The parties will not appeal to the courts until they have made every effort to settle the dispute in mutual consultation.
  4. Only the competent court within the district of the District Court of Amsterdam will be appointed in the first instance to take cognizance of any legal disputes between the Parties, without prejudice to the right of Biker Outfit to designate another competent court according to the law. However, a Consumer is entitled to choose the competent court according to the law within one month after Biker Outfit has announced In Writing that it wishes to litigate with the court designated by it.
  5. If these general terms and conditions are available in several languages, the Dutch version thereof is always decisive for the interpretation of the stipulations contained therein.
